These Terms of Use (hereinafter referred to as the 'Terms') apply to forent Co., Ltd. (hereinafter referred to as the 'Company'). This website defines the terms of use for the services provided on this website (hereinafter referred to as the "Services"). All registered users (hereinafter referred to as "Users") must use this Service in accordance with these Terms. Hereinafter, members and third parties providing services are referred to as "<strong>Host</strong>". Article 1 (Application)

These Terms of Use shall apply to all relationships related to the use of the Service between the user and the Company.

Article 2 (Registration for Use)

  1. Registration is completed when a prospective user applies for registration in the manner specified by the Company and the Company approves the application.
  2. If the Company determines that the applicant has any of the following reasons, the Company may not approve the application for registration of use and shall not be obliged to disclose the reasons for such denial.
    1. If false information is reported when applying for user registration
    2. If the application is from a person who has violated these Terms and Conditions
    3. The applicant is a minor, an adult ward, a person under curatorship or a person under assistance, and has not obtained the consent of his/her legal representative, guardian, conservator or assistant.

Article 3 (Management of User ID and Password)

  1. The User shall manage his/her user ID and password for the Service at his/her own responsibility.
  2. The User may not, under any circumstances, transfer or lend his/her user ID and password to any third party. When a user logs in with the same combination of user ID and password as the registered information, the Company will consider the use of the service to be by the user who has registered the user ID.

Article 4 (Clauses Concerning Hosts)

  1. Provisions applicable to all listings
    1. If you create a listing on the Service, you are responsible for including complete and accurate information about the Hosted Services and for keeping the information in your listing current at all times.
    2. Fees related to listings (hereinafter referred to as “<strong>Listing Fees</strong>”) The host is solely responsible for configuring the . Once a guest makes a reservation and submits a reservation request, Guests may not be asked to pay more than the amount stated in their reservation.
    3. Any and all terms and conditions to be included in the listing must be consistent with these Terms and Conditions or the cancellation policy set forth in the listing.
    4. When the Host approves or pre-approves a reservation request, a legally binding contract is formed with the Guest at that time and the Guest is required to provide the Host services as described in the listing at the time the reservation request is made. You also agree to pay any applicable host service fees and taxes.
  2. service charge
    1. As consideration for using the platform of this service, we will pay a fee to the host (hereinafter referred to as “ You may be charged a service fee (referred to as a <strong>Service Fee</strong>).
    2. The applicable service fee (including any applicable taxes) will be displayed to the Host prior to publication of the listing. We reserve the right to change the service fee at any time and will provide appropriate notice of any fee changes to the Host prior to the fee change becoming effective.

Article 5 (Clauses Concerning Guests)

  1. Provisions applicable to all reservations
    1. When reserving a Listing available through the Service, you will follow the respective reservation process in accordance with the requirements established by the Company and the Host. All applicable fees, including listing fees, guest service fees and taxes (if applicable) (collectively, the "Total Fee") will be presented to you prior to booking a listing. You agree to pay the Gross Charges for the requested reservation.
    2. Upon receipt of the reservation confirmation from us, a legally binding contract is formed between the guest and the host, subject to compliance with the applicable host's additional terms and conditions (including in particular the applicable cancellation policy and any rules specifically mentioned in the listing). We will collect the total fee at the time of the reservation request or at the time of approval by the Host, subject to the Payment Terms.
  2. Reservation changes, cancellations and refunds
    1. Host and Guest agree that Host and Guest shall be responsible for any changes to reservations made through the Service ("Reservation Changes") and agree to pay any additional listing fees, host service fees, guest service fees and taxes associated with such Reservation Changes.
    2. Guests may cancel confirmed reservations at any time in accordance with the provisions of the listing's cancellation policy, and we will refund the portion of the total fee received by the guest as specified by such cancellation policy.
    3. If a confirmed reservation is cancelled by the host, the guest will be refunded the full amount of the total charges for such reservation within a commercially reasonable period of time.
  3. Use and damage of host services
    1. Guests are responsible for maintaining the facilities they use (including any personal belongings or other property present in the facility) in the condition they were in at the time of their arrival. In addition to your own acts and omissions, you are responsible for the acts and omissions of any individual to whom you invite or otherwise use the accommodation (other than the Host (and, if any, the individual to whom the Host has invited you to use the accommodation)).
    2. If the Host claims, upon presentation of evidence, that a guest has caused damage to the facility or to personal or other property located at the facility, the Host may seek payment from the guest through the Company. If the Host requests the Company to adjudicate the damage claim, the guest, the guest, will be given an opportunity to respond.

Article 6 (Method of Payment and Method of Receiving Payment)

  1. If you add your own payment or payment receipt method, you must provide us or our designated payment processor with general billing information (such as your name, billing address, and payment method information). You must provide accurate, current, and complete information when adding a payment method or payment acceptance method, and it is your obligation to keep the information regarding payment methods and payment acceptance methods current. The information required for each method of payment receipt will vary depending on the individual method of payment receipt and may include the following
    • Customer's address, account holder, account type, routing number, account number
    • E-mail address, currency received
    • Individual payment processor account information
  2. When you add or use a new Payment Method, we may authenticate such Payment Method by verifying your account through a third party payment service provider (payment processor). For the purpose of further authentication, we may (i) perform one or two small payment authorizations for your Payment Method, or (ii) require you to upload an invoice. We may and reserve the right to request a refund of such amounts from this Payment Receipt Method. If you add a payment method at the time of payment, we will automatically store such payment method in your account for use in subsequent transactions.
  3. You are solely responsible for the accuracy and completeness of the information regarding your Payment Method and Payment Acceptance Method. We will not be liable for any loss incurred by you due to inaccuracies in the information provided by you regarding the Payment Method and Payment Acceptance Method.
  4. In order for the host to receive payment, the guest must have a valid payment receipt method linked to his/her account. Under normal circumstances, we will initiate payment for the payment receipt method you select within one week from the time the guest's reservation is confirmed.
  5. The period of time required for you to receive the money transferred from us will depend on the payment and receipt method you select and the processing time of the payment and receipt processor of such payment and receipt method. We may postpone or cancel the payment of the receipt for the purpose of prevention of illegal activities or fraud, risk assessment, security, or investigation.
  6. Your deposit for the reservation will be the listing fee less applicable host service fees.
  7. In the event of cancellation of a confirmed reservation by the Guest, we will remit the portion of this Receipt payable to the Guest out of the total charges in accordance with the provisions of the applicable cancellation policy.

Article 7 (Prohibited Matters)

In using the Service, the User shall not engage in any of the following acts
  1. Acts that violate laws and regulations or public order and morals
  2. Conduct related to criminal activity
  3. (iii) acts that destroy or interfere with the functionality of our servers or network
  4. Actions that may interfere with the operation of our services
  5. Collecting or accumulating personal information about other users.
  6. Impersonating another user
  7. (iii) Acts of providing benefits directly or indirectly to antisocial forces in relation to the Company's services
  8. (iii) Acts that infringe on the intellectual property rights, portrait rights, privacy, honor, or other rights or interests of the Company, other users of this service, or third parties.
  9. Posting or transmitting excessively violent expressions, sexually explicit expressions, expressions that lead to discrimination based on race, nationality, creed, gender, social status, family origin, etc., expressions that induce or encourage suicide, self-harm, or drug abuse, and other expressions that contain antisocial content and cause discomfort to others.
  10. Actions for the purpose of sales, publicity, advertising, solicitation, or other commercial purposes (excluding those approved by the Company). (ii) Acts for the purpose of sexual or obscene acts, acts for the purpose of meeting or dating with the opposite sex whom you have not met, acts for the purpose of harassing or slandering other customers, and acts for other purposes that differ from the intended use of the service.
  11. Religious activities or solicitation of religious organizations
  12. Offering to host through the Service any premises that you do not own or have permission to use as residential or other real estate.
  13. Using the Service for the purpose of requesting, reserving, or accepting reservations unrelated to the Service in order to avoid payment of a service fee or for any other reason.
  14. Request, receive or pay any payment for any Listing Fee without going through the Services. If you do so, you acknowledge and agree that (i) you will be in breach of these Terms and Conditions, (ii) you assume all risk and responsibility for such payment, and (iii) you will indemnify us for any liability resulting from such payment.
  15. Other acts that the Company deems inappropriate.

Article 8 (Suspension of Provision of the Service, etc.)

MCC reserves the right to suspend or discontinue all or part of the Service without prior notice to the user for any of the following reasons
  1. When performing maintenance inspections or updating of computer systems related to this service
  2. (iii) When it becomes difficult to provide this service due to force majeure such as earthquake, lightning, fire, power outage, or natural disasters.
  3. In the event of computer or communication line outage due to accident
  4. (iii) In any other cases where the Company deems it difficult to provide this Service.
  5. We shall not be liable for any disadvantage or damage incurred by the user or any third party due to the suspension or interruption of the provision of the Service, regardless of the reason.

Article 9 (Copyright)

  1. Users may only use, post, or edit text, images, videos, and other information for which they own the necessary intellectual property rights, such as copyrights, or have obtained permission from the necessary right holders.
  2. Copyrights to text, images, videos, etc. posted or edited by users using the service shall be reserved to the users concerned or other existing right holders. However, we may use text, images, videos, etc. posted or edited using the service, and users shall not exercise their moral rights with regard to such use.
  3. Except as provided in the main text of the preceding paragraph, all copyrights and other intellectual property rights to the Service and all information related to the Service belong to the Company or to the right holders who have authorized the Company to use them, and users shall not reproduce, transfer, lend, translate, modify, reprint, publicly transmit (including making transmittable), transmit, distribute, publish, or commercially use without permission. The User shall not reproduce, transfer, lend, translate, modify, reprint, publicly transmit (including making transmittable), transmit, distribute, publish, or commercially use the information.

Article 10 (Restriction of Use and Cancellation of Registration)

  1. We reserve the right to delete posted data, restrict a user's use of all or part of the Service, or terminate a user's registration without prior notice in the following cases
    1. Violation of any of the provisions of these Terms and Conditions
    2. When it is found that there is a false fact in the land registration
    3. (iii) When a petition is filed for bankruptcy, civil rehabilitation, corporate reorganization, or special liquidation proceedings.
    4. If you have not used this service for more than 1 year
    5. If you have not responded to our inquiries or other communications requesting a response for more than 30 days
    6. When any of the items of Article 2, Paragraph 2 applies.
    7. (iii) In any other cases in which the Company deems the use of the Service to be inappropriate.
  2. In the event that any of the items of the preceding paragraph applies, the User shall naturally lose the benefit of time with respect to all debts owed to the Company, and shall immediately repay all debts owed to the Company at that time in a lump sum.
  3. MCC shall not be liable for any damages incurred by the user as a result of actions taken by MCC in accordance with this Article.

Article 11 (Disclaimer of Warranty and Disclaimer of Liability)

  1. (2) We do not warrant, expressly or impliedly, that the Service is free from defects in fact or in law (including safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, security or other defects, errors or bugs, infringement of rights, etc.). (including, but not limited to, defects in safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, security, etc., errors and bugs, and infringement of rights).
  2. (2) The Company shall not be liable for any and all damages incurred by the User arising out of the Service. However, this disclaimer does not apply if the contract between the Company and the user for the Service (including this agreement) is a consumer contract as defined in the Consumer Contract Act. However, this disclaimer does not apply if the contract between the Company and the user regarding the Service (including this agreement) is a consumer contract as defined in the Consumer Contract Act.
  3. (2) Even in the case of the proviso of the preceding paragraph, SBM shall not be liable for damages arising out of special circumstances (including cases in which SBM or the User foresaw or could have foreseen the occurrence of the damages) among damages incurred by the User due to negligence (excluding gross negligence), default of obligation by SBM, or tort. (2) Even in the case of the proviso of the preceding paragraph, the Company shall not be liable for damages arising out of special circumstances (including cases where the Company or the User foresaw or could have foreseen the occurrence of damages) among damages incurred by the User due to default or tort caused by the negligence of the Company (excluding gross negligence). (including cases in which the Company or the User foresaw or could have foreseen the occurrence of the damage). In addition, the Company shall not be liable for damages arising out of the negligence of the Company (excluding gross negligence), default by the Company, or tortious acts. In addition, compensation for damages incurred by a user due to default or tort caused by the negligence (excluding gross negligence) of the Company shall be limited to the amount of usage fees received from the user for the month in which the relevant damages occurred.
  4. We are not responsible for any transactions, communications, or disputes that occur between users and other users or third parties in connection with the Service.

Article 12 (Change of Service Contents, etc.)

MUTOH HOLDINGS reserves the right to change the contents of the Service or discontinue providing the Service without notice to the User, and shall not be liable for any damages incurred by the User as a result of such changes or discontinuation.

Article 11 (Modification of Terms of Use)

MHI reserves the right to change these Terms of Use at any time without notice to the User if it deems such change to be necessary.

Article 13 (Notice or Communication)

Notification or communication between a user and the Company shall be made by the method prescribed by the Company.

Article 14 (Prohibition of Assignment of Rights and Obligations)

The User may not transfer or offer as security his/her position under the Service Agreement or his/her rights or obligations under this Agreement to any third party without prior written consent of the Company.

Article 15 (Governing Law and Jurisdiction)

  1. These Terms and Conditions shall be governed by and construed in accordance with the laws of Japan.
  2. In the event of any dispute concerning the Service, the court having jurisdiction over the location of the Company's head office shall have exclusive jurisdiction.
